By creating an account, accessing our platform, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you do not agree to these Terms, you may not access or use Serene Space AI.

You must meet the following requirements to use Serene Space AI:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable law
• Provide accurate and complete registration information

By using our platform, you represent and warrant that you meet these eligibility requirements.

3.1 What Serene Space AI Provides

Serene Space AI is an AI-powered wellness coaching platform that offers:

• Access to 30+ specialized AI coaches
• Voice and text-based coaching sessions
• Evidence-based wellness support using CBT, DBT, ACT, and mindfulness frameworks
• Mood tracking and progress insights
• 24/7 availability

4.1 Account Creation

To use Serene Space AI, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

4.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• We recommend enabling two-factor authentication for enhanced security

4.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

5. Subscription and Payment

5.1 Subscription Plans

Serene Space AI offers the following subscription plans:

• Monthly Plan: $14.99 per month, billed monthly
• Annual Plan: $119.99 per year, billed annually

5.2 Free Trial

• New users receive their first month free
• A valid credit card is required to start the free trial
• If you do not cancel before the trial ends (day 31), you will be automatically charged for your selected plan
• Only one free trial per user

5.3 Billing

• Subscriptions automatically renew until cancelled
• You will be charged on the renewal date for your subscription
• Prices are in U.S. Dollars (USD)
• All payments are processed securely through our third-party payment processor
• We do not store your full credit card information

5.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain access until the end of your paid period
• No refunds are provided for partial months or unused time
• If you cancel during the free trial period, you will not be charged

5.5 Price Changes

We reserve the right to modify subscription pricing with at least 30 days' notice. Price changes will not affect your current billing cycle.

6. Acceptable Use

6.1 Permitted Use

You may use Serene Space AI for:

• Personal wellness and emotional support
• Developing coping strategies and self-awareness
• Tracking your mood and mental wellness progress
• Practicing evidence-based wellness techniques

6.2 Prohibited Use

You agree NOT to:

• Use the platform as a substitute for professional medical or mental health care
• Rely on AI coaches for crisis intervention or emergency situations
• Share your account credentials with others
• Attempt to reverse-engineer, hack, or compromise the platform
• Use the platform for any illegal purpose
• Harass, abuse, or attempt to exploit AI coaches or the system
• Upload malicious code, viruses, or harmful content
• Scrape, copy, or redistribute platform content without permission
• Impersonate others or provide false information
• Use automated systems or bots to access the platform

7. Intellectual Property

7.1 Our Property

All content, features, and functionality of Serene Space AI—including but not limited to text, graphics, logos, AI models, software, and data—are owned by Serene Space AI and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Serene Space AI for personal, non-commercial purposes, subject to these Terms.

7.3 Your Content

You retain ownership of any content you provide to Serene Space AI (including conversations and journal entries). By using our platform, you grant us a license to use, store, and process this content solely to provide and improve our services.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• All conversations are encrypted with healthcare-grade security
• We never sell your data
• You can delete your account and data at any time
• Our practices are designed to align with HIPAA standards

9. Disclaimers and Limitations

9.1 No Medical Advice

9.2 AI Limitations

• AI coaches are artificial intelligence systems, not human professionals
• AI may make mistakes, provide incomplete information, or misunderstand context
• AI cannot provide the same level of care as licensed therapists
• AI cannot detect or respond to emergencies appropriately

9.3 Service Availability

While we strive for 24/7 availability, we do not guarantee uninterrupted access to Serene Space AI. The platform may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

9.4 No Warranty

SERENE SPACE AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERENE SPACE AI, ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• User reliance on information provided by AI coaches
• Any damages exceeding the amount you paid to Serene Space AI in the 12 months preceding the claim

11. Indemnification

You agree to indemnify, defend, and hold harmless Serene Space AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you provide to the platform

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

12.2 Arbitration Agreement

Any dispute arising from these Terms or your use of Serene Space AI shall be resolved through binding arbitration, except for disputes that may be brought in small claims court.

You agree to:

• Waive your right to a jury trial
• Waive your right to participate in class action lawsuits
• Resolve disputes individually through arbitration

12.3 Opt-Out

You may opt out of the arbitration agreement by sending written notice to info@serenespace.ai within 30 days of account creation.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of Serene Space AI after changes constitute acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Serene Space AI regarding use of the platform, superseding any prior agreements.
